Terms of use

AniTend is operated by Cathcart Ventures Pty Ltd in Australia. These terms govern access to and use of AniTend, including account responsibilities, payment obligations and limits on liability. Updated 1 October 2026.

1. The service and your account

These terms apply to AniTend’s website and My Pets, Breeder and Rescue services. By registering, purchasing a plan or using AniTend after being given notice of these terms, you agree to them. “We”, “us” and “our” mean Cathcart Ventures Pty Ltd. “You” includes the person or organisation holding the account. You must be at least 18 to hold an account, provide accurate account details and have authority to act for any household, business or organisation you represent.

Keep your sign-in details secure, use individual invitations rather than sharing passwords, and tell support@anitend.com promptly if you suspect unauthorised access. Owners and administrators are responsible for assigning suitable roles, authorising their users and removing access that is no longer needed. You are responsible for activity you authorise and for loss caused by your failure to take reasonable steps to protect account access.

2. Animal care and professional advice

AniTend records information and helps organise work. It does not provide veterinary diagnosis, prescribe treatment, supervise animals or decide whether an animal or applicant is suitable for a placement. You remain responsible for lawful animal care, breeding, sale, fostering and adoption, including any registrations, disclosures, welfare requirements and local rules that apply to you.

You are responsible for the accuracy and suitability of information you enter, confirm, share or act on. Check feeding directions, units, weights, medication instructions, calculations and entries before using them. Follow the current product label and your veterinary professional’s instructions. Reminders depend on permissions, connectivity and device behaviour and may be delayed or missed. Use a separate check for time-critical care and seek veterinary help for urgent concerns.

3. AI-assisted tools

AI Help explains documented AniTend controls. It cannot inspect or change your animal records or carry out actions for you. Feeding-label reading produces draft information for you to confirm. Outputs may be inaccurate, incomplete or unsuitable for a particular animal or situation. You must independently check them before relying on them. They are not veterinary, legal or other professional advice, and must not be used as the sole basis for care, treatment, placement or contractual decisions.

Do not enter personal, confidential or medical information into AI Help. Upload only the label image needed for label reading. Our Privacy Policy explains the information sent to service providers. The product manual remains available when AI Help is unavailable or its daily allowance is used.

4. Plans, renewal and charges

My Pets Free is A$0. My Pets Plus is A$4.99 per month or A$49.99 per year. Breeder and Rescue are each A$8.99 per month or A$89 per year. The order summary shows the billing period, total payable and any applicable tax before you confirm a purchase. Joining the early launch list is not a purchase and does not authorise a charge.

Paid subscriptions renew automatically for the period you select until cancelled. You authorise the agreed subscription charges through the payment provider. You must keep your billing details current. We may suspend paid features for overdue agreed charges after reasonable notice, unless immediate action is needed to address suspected fraud. We will communicate a price change before it applies to a future renewal so you can decide whether to continue.

Breeder and Rescue include My Pets Plus for the subscription owner’s own pets while their subscription remains active. Buyers and adopters can accept the animal’s transferred record in My Pets Free. Invited carers receive the access permitted by their role, not an independent paid subscription. Free-plan allowances and optional ad unlock availability are shown in the service and on the pricing page.

5. Cancellation, refunds and deletion

Manage or cancel a website subscription through Account & Settings and the billing portal. A subscription purchased through Google Play or the Apple App Store must be managed or cancelled through that store’s subscription controls; the app provides a link to those controls. Store purchases are also subject to the relevant store’s billing and refund rules. If that is unavailable, contact support@anitend.com. Cancellation takes effect at the end of the current paid billing period and prevents the next renewal. You must complete cancellation before renewal to prevent the next period being charged. Deleting the app, not using the service or joining a different workspace does not cancel a subscription.

Cancellation does not itself delete an account. Export records you need before requesting deletion or losing access to paid features. Account deletion has its own confirmation and processing steps. Information retained for legal, accounting, security or backup purposes is addressed in the Privacy Policy.

Except where required by law or expressly stated in these terms, subscription fees are non-refundable for change of mind, non-use or cancellation during a paid billing period, and unused days are not credited. Any discretionary credit or refund is assessed individually and does not create an entitlement for other periods or accounts. The mandatory-law protection in section 10 applies to this clause.

6. Agreements, electronic signatures and animal payments

Optional electronic signing is A$1.99 per agreement sent, separate from a subscription. The sending screen asks you to confirm the charge. Depending on the available billing arrangement, payment is collected before sending or included in usage billing. Preparing or storing an agreement does not itself incur a sending charge. A successfully sent request is chargeable even if a recipient later declines or does not sign. A failed send that was not completed is not a successfully sent request; duplicate charges are not authorised by these terms.

You are responsible for the agreement’s content, parties, identity checks, authority, suitability and any legal requirements for signing it electronically. Templates and signing tools are not legal advice and do not guarantee enforceability. Review the completed document and signing record and keep your own copy.

AniTend is not a party to your animal sale, adoption or foster arrangement, and is not an escrow service. Recording a deposit, balance or refund does not itself move money or prove payment. The relevant parties remain responsible for their payments, disputes and obligations. We do not verify or warrant an animal’s health, ownership, pedigree or suitability, an applicant’s identity or suitability, or another user’s performance of an agreement. Using AniTend does not make us a seller, breeder, rescue organisation, agent, broker, guarantor or adviser in your transaction.

7. Your records, permissions and handovers

You retain your rights in the information, photographs and documents you provide. You grant us a non-exclusive, royalty-free licence to host, store, reproduce, process, back up, display and transmit that material only as reasonably needed to operate and secure the service, follow your sharing instructions and meet legal obligations. We may authorise our service providers to perform those tasks on our behalf, subject to the Privacy Policy. This is not a transfer of ownership of your content.

Only upload or share material you are entitled to use. Tell people how you are using their information and obtain any required authority or consent. Review recipients, attachments and role permissions before sending invitations, reports, questionnaires, agreements or handovers.

A handover transfers the individual animal’s prepared record when accepted by the recipient; it does not grant access to the source workspace or transfer private internal finances and applicant records. Check what is included before sending. Removing access or deleting your account cannot recall copies another person has already received, downloaded or lawfully retained.

8. Acceptable use and AniTend’s materials

Do not use AniTend for unlawful activity, animal mistreatment, harassment, misleading records, infringement of another person’s rights, malicious uploads, unauthorised access or interference with the service. Do not attempt to defeat account permissions, security controls, usage allowances or payment requirements. Do not introduce malware, scrape private records, overload the service, impersonate another person or reverse engineer the software except to the extent permitted by law.

AniTend’s software, branding, manuals and other service materials remain the property of their owners. Your account gives you permission to use the service for its intended purpose, not to copy, resell or misrepresent it as your own. Third-party materials remain subject to their owners’ rights.

9. Availability, suspension and service changes

AniTend depends on internet connectivity, compatible devices and third-party services. We do not promise uninterrupted or error-free access, delivery of every notification, or any particular animal-care, placement or business outcome. Third-party links and integrations are not an endorsement or guarantee of those providers. Keep independent copies of records you must retain and a practical backup for essential animal care. These limitations are subject to section 10.

We may remove prohibited content or restrict or suspend access where reasonably necessary to address a security threat, unlawful use, a material breach of these terms or unpaid agreed charges. We may terminate an account for a serious breach or a material breach that remains unresolved after reasonable notice. Where practicable, we will explain the reason and give a reasonable opportunity to resolve it. Urgent protective action may be taken first, followed by notice when safe and lawful.

We may improve or change the service. We will give reasonable advance notice of material changes to these terms or paid features, except where an urgent legal or security change is necessary. A materially adverse change during a prepaid period permits cancellation of the affected service and a proportionate refund for its unused prepaid period. If we discontinue a paid service, we will provide reasonable notice, an opportunity to export available records and a proportionate refund for the discontinued unused prepaid period. Changes do not apply retrospectively.

10. Liability and mandatory law

Nothing in these terms excludes, restricts or modifies any liability, guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law. This qualification applies to every exclusion, limitation and refund provision in these terms.

Subject to that qualification, we are not responsible for loss to the extent caused by inaccurate or incomplete information supplied by you or another user, your failure to verify outputs or instructions, unauthorised sharing by you, your animal-care or placement decisions, or another party’s breach of a sale, adoption, foster or payment arrangement. This does not exclude responsibility to the extent our own breach, negligence or unlawful conduct caused or contributed to that loss.

To the extent permitted by law, neither party is liable to the other for indirect or consequential loss that was not reasonably foreseeable when the relevant service was acquired. This exclusion does not apply to fraud, wilful misconduct, breach of confidentiality or privacy obligations, or liability that cannot lawfully be excluded.

For services acquired principally for business purposes, and only to the extent permitted by law, our total aggregate liability arising from the service in any 12-month period is limited to the greater of A$1,000 and the fees you paid us for that service in the preceding 12 months. This cap does not apply to liability under non-excludable consumer guarantees, fraud, wilful misconduct, breach of confidentiality or privacy obligations, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited. It does not apply to services acquired principally for personal, domestic or household use.

Each party must take reasonable steps to reduce any loss it becomes aware of. Neither party is responsible for the part of a loss caused or increased by the other party’s failure to take those steps, to the extent permitted by law.

11. Third-party claims arising from misuse

To the extent permitted by law, you must reimburse us for reasonable, substantiated losses and external legal costs arising from a third-party claim, but only to the extent directly caused by your deliberate unlawful use of AniTend, your infringement of that third party’s intellectual property or privacy rights, or a material breach by you of sections 6, 7 or 8.

This obligation is reduced to the extent we or our service providers caused or contributed to the loss. We must promptly notify you of the claim, take reasonable steps to minimise the loss and give you a reasonable opportunity to participate in its defence. We will not agree to a settlement requiring payment or an admission by you without your prior consent, which must not be unreasonably withheld. This clause does not make you responsible for our own negligence or misconduct.

12. Notices, disputes and general provisions

For service or billing matters, contact support@anitend.com. Formal notices to Cathcart Ventures Pty Ltd should be sent to hello@anitend.com. Keep your account email current; we may send service and contractual notices to that address or display them in your account.

Before commencing ordinary court proceedings, each party must give written notice describing the dispute and make reasonable, good-faith efforts to resolve it for 30 days after receipt. This requirement does not prevent urgent protective relief, action needed to preserve a legal time limit, or the exercise of a statutory complaint or other non-excludable right.

These terms are governed by Queensland law. The parties submit to the non-exclusive jurisdiction of Queensland courts and courts entitled to hear appeals from them, subject to any mandatory law that requires otherwise.

If a provision is unenforceable, it is severed to the extent necessary and the remaining provisions continue. A failure or delay in enforcing a provision is not a waiver. Accrued payment obligations and provisions concerning intellectual property, records already shared, liability and disputes continue after an account or subscription ends to the extent relevant.
